PRAKTIK MAROBATI TERNAK KAMBING DALAM PERBERDAYAAN MASYARAKAT DI DESA TURI MENURUT PERSPEKTIF AKAD MUDHARABAH

Abstract

The implementation of determining the profit sharing ratio in the goat farming cooperation agreement in Turi Village, Panekan District, is divided into 2 models. Firstly, there are some who divide based on the order of children born and according to the author, this type of contract is haram because there are many ambiguities in the distribution of profit sharing. Second, most people determine profit sharing based on a percentage that has been agreed at the beginning and this is in accordance with the principles of the mudharabah concept in the DSN MUI fatwa no. 07 of 2000 and is legally valid according to the author. This research uses qualitative research with an empirical normative approach. The results of the research concluded that the implementation of cooperation in raising goats in Turi Village, Panekan District, began with a verbal agreement between both parties to cooperate in raising goats, where the shahibul mal (capital owner) provided the goats and the mudharib (manager) was responsible for looking after the goats. The law is divided into two, first, the law is haram if the determination of profit sharing is based on the order of children born. Both laws are valid if the determination of profit sharing is based on a percentage in accordance with the initial agreement.
